La visitaduría de Zamora de la Comisión Estatal de los Derechos Humanos (CEDH) ya comenzó a recibir los primeros casos de violencia política concernientes a este proceso electoral 2023-2024, informó Juan Jaime Contreras Vega, visitador regional de la CEDH en Zamora.
Indicó que el primer asunto se trata de un regidor de Purépero y el segundo de un síndico y una regidora del consejo sustituto que gobierna Penjamillo, Michoacán, «en ambos casos, estos funcionarios se quejan de arbitrariedades y de obstrucción al ejercicio de sus derechos políticos electorales, quienes comparecieron en esta visitaduría para hacer extensivas sus quejas por la posible violación a sus derechos humanos».
Al ser causas de incompetencia para el actuar de esta visitaduría, emitieron un decreto en el cual se declararon incompetentes e hicieron la remisión al Tribunal Electoral del Estado de Michoacán (TEEM), al cual le mandaron las constancias de las quejas que levantaron y este, al hará el análisis de los hechos y revisar ambas causas, «no quiere decir que los derechos político-electorales, no sean derechos humanos, pero hay tribunales especificas para la ventilación de este tipo de asuntos».
«En el caso del asunto de Purépero, donde el regidor se queja de vulneración a sus derechos político-electorales, ya que señala que el presidente de dicho municipio no le permite un libre ejercicio de su encargo público, el TEEM se declaró incompetente y ordena canalización al Instituto Electoral del Estado de Michoacán (IEM), argumentando que este es el órgano competente para ventilar este tipo de asuntos, a través del procedimiento especial sancionador (PES) y a la Fiscalía, por lo que refiere a la violencia política, por si hubiese alguna conducta que pudiera ser causa de un delito».
Dio a conocer que la visitaduría, por instrucciones del presidente, Marco Antonio Tinoco Álvarez, hizo el acompañamiento al quejoso y se presentaron los recursos e impugnaciones correspondientes sobre la determinación del TEEM, de declararse incompetente, “toda vez que a nuestro criterio ese tipo de asuntos deben ser resueltos a través de un juicio de derechos ciudadanos (JDC) que se tramitan y resuelven en el TEEM».
«Por lo que recurrimos el acuerdo de incompetencia y de remisión del TEEM y es día que esta causa ha escalado a la Sala Regional Toluca del Poder Judicial de la Federación, escala a este nivel porque es la instancia última sobre este tipo de casos, por lo que estamos esperando la decisión de esta Sala para ver si el TEEM es o no competente o lo tendrá que resolver el IEM o si esta visitaduría de la CEDH tuviera que resolver en el fondo la posible recomendación por una aparente violación a derechos humanos».
Finalmente dijo que, en tanto, el asunto de Penjamillo aún no se resuelve, “aun no nos notifican el resultado de su acuerdo de radicación”.
