El Colegio de Abogados Laboristas de Michoacán estableció una alianza con el Consejo Coordinador Empresarial de la Región Zamora (CCEZ), a fin de acercar a los empresarios a la capacitación en torno al nuevo sistema de justicia laboral (NSJL)y las nuevas reformas en la materia, esto para evitar conflictos que pongan en riesgo su estabilidad jurídica y financiera y sanciones o requerimientos por parte de instancias fiscalizadoras o la Secretaría del Trabajo y Previsión Social (STyPS).
Luis Fernando Rodríguez Vera, presidente del Colegio citado, expresó, «es fundamental formalizar las relaciones de trabajo, es el gran reto que los laboristas apreciamos porque ya no podemos estar en la informalidad. Hay compromisos por parte del estado mexicano con el Tratado de Libre Comercio el T-MEC, del cual deriva todo este cumplimiento».
Dijo que, por tanto, los empresarios, el sector patronal y la clase trabajadora se deben preparar para esta nueva dinámica, ya que no solamente es el cambio en la justicia laboral, sino el cambio en todas las relaciones de trabajo que se avecinan, “hay temas novedosos, el caso de las vacaciones, que ahora ya se duplican, por lo que es un reto importante para el empresario que debe cumplir».
«La idea es ayudar a las empresas para fortalecerlas como sujetos sociales, que es para lo que están creadas. Es parte de la tarea que tenemos como reto, como Colegio estaremos atentos a cualquier inquietud que surja por parte de los empresarios», agregó.
Dio a conocer que el próximo 26 de enero a las 6 pm se ofrecerá una conferencia al respecto sobre el NSJL, el lugar aún está por definirse, o bien, ante cualquier orientación pueden acudir a las instalaciones del CCEZ.
Mencionó que los usuarios, empresarios y trabajadores no conocen los alcances de la justicia laboral, “por ello la labor que realizamos como Colegio es difundir mediante diversos congresos, seminarios y cursos de capacitación esta nueva modalidad a efecto de que la justicia realmente sea efectiva».
Dijo, «la ley federal del trabajo es protectora de derechos de trabajadores. Por tanto, el sector patronal tiene que tomar en consideración todos esos derechos, respetar y sean efectivos, para beneficio de su centro de trabajo».
Subrayó que la ley federal del trabajo considera que haya relaciones de trabajo armoniosas, que en los centros de trabajo haya producción, equilibrio entre los factores de la producción, “precisamente, lo que más se trata de buscar es ese equilibrio, entenderlo en los centros de trabajo, porque siempre habrá mayores presunciones en favor de los trabajadores».
Resaltó que el reto del empleador es organizarse de manera interna, “que ahora pueda enfrentar esta justicia de manera más eficaz, porque también estaremos frente a un juez que nos va a estar dirigiendo los procesos, por lo que ya no podrán alterar documentos, testigos y hechos que no deben ser».
Por tanto, puntualizó, la tarea es difundir los alcances de esta reforma y hacer conciencia en los sectores, “tanto el empresario tiene esa necesidad de organizarse de manera interna para evitar el conflicto laboral como los trabajadores esa responsabilidad de que en algún momento de la exigencia de sus derechos también puedan llegar a conciliarlos».
Finalmente, Jesús Fernández Arias, presidente del CCEZ, dijo que afortunadamente van a tener un gran respaldo de los 26 abogados laboristas que conforman este Colegio. En caso de que algún contribuyente le llegue un requerimiento o alguna verificación, pueden acercarse al CCEZ para resolver todas sus dudas.
