«Está prohibido que patrones te manden WhatsApp una vez que culminas tu jornada laboral, o que te llamen para un trabajo extra que debes realizar.
Se hace mucho en la actualidad y mediante los dispositivos móviles, inclusive a deshoras de la mañana andan haciendo estas prácticas. La Ley lo prohíbe», señaló Belén Villagómez León, Directora del Centro de Conciliación Laboral, región Zamora.
«Sin embargo, si se llega a un acuerdo por parte del patrón y del trabajador. Y este último acepta trabajar de esa manera, ya es un acuerdo entre ellos, igualmente dependiendo la labor y los horarios establecidos. Pero de antemano, el trabajador no está obligado a contestar esos mensajes, ni a realizar jornadas fuera de sus horarios de trabajo. Si así lo hacen tenemos que apegarnos a lo que marca la ley y cubrir el pago de dichas horas extras».
A pregunta expresa si está situación podría considerarse una especie de acoso laboral, expresó, «hay muchos negocios que tienen necesidades, las cuales deben cubrirse, pero también los patrones deben entender que el trabajador tiene una vida propia, personal y que, si tiene un horario de trabajo, este se debe respetar».
Añadió, «se puede tomar como acoso, cuando el patrón insiste e insiste y el trabajador no está dispuesto ni a contestar esos mensajes, ni a irse a trabajar en horarios que no le corresponden. Pero considero que más bien es una cuestión de dialogo que platique el trabajador con el patrón y de acuerdo a las necesidades, lleguen a un arreglo».
«Represento a un Centro de Conciliación y el día de mañana que me lleguen en una situación de esa índole, voy a tratar de que esa gente pueda llegar a un buen convenio. Cabe mencionar que cuando el patrón no cumple con esa disposición no hay multa, más bien es una causa de rescisión laboral no atribuible al trabajador», finalizó.
